Terms & Conditions - Max Promotion

 

1. General

1.1 Starting 19 November 2024, StarHub may run promotions for StarHub TV+, StarHub Post-Paid Mobile, StarHub Broadband and/or HomeHub+ Services from time to time on terms and conditions to be prescribed by StarHub and under the terms below, StarHub is currently offering subscription to Max subject to eligibility criteria and acceptance of additional terms as may be advised by WarnerMedia Direct Asia Pacific, LLC (“Promotion”).

1.2 The terms and conditions for the Promotion is set out below (“Promotion Terms & Conditions”).

1.3 In addition to these Promotion Terms & Conditions, the StarHub Service that you have subscribed for is subject to StarHub's Consumer General Terms & Conditions, Service Specific Terms & Conditions for StarHub TV+ Services, StarHub Post-Paid Mobile Services, StarHub Broadband Services, HomeHub, fair usage policies (as applicable) and any further terms and conditions that we may have agreed to from time to time. You may view our terms and conditions at http://www.starhub.com.

1.4 If there is any conflict or inconsistency between any provision of these Promotion Terms & Conditions, the Consumer General Terms & Conditions and Service Specific Terms & Conditions, the documents shall be construed in the following descending order of precedence:

1.4.1 Promotion Terms & Conditions;

1.4.2 Service Specific Terms & Conditions for StarHub TV+ Services, StarHub Post-Paid Mobile Services, StarHub Broadband Services, HomeHub, fair usage policies (as applicable); and

1.4.3 Consumer General Terms & Conditions.

1.5 By participating in the Promotion, you agree to the disclosure of your personal data in the manner set out in these Promotion Terms & Conditions and/or any other terms and conditions as may be advised by WarnerMedia Direct Asia Pacific, LLC. Once your Max account is activated, your use of Max service and the Max app, including the features and functionality contained therein, will be subject to Max’s Terms of Use and Max’s Privacy Policy. If there is a conflict between Max’s Terms of Use relating to the Promotion, and these terms, these terms will prevail. If and to the extent that Max’s Terms of Use conflict with these terms relating to the use of Max, Max’s Terms of Use shall prevail.

2. Max Service

2.1 Available from 19 November 2024, Max is a paid for streaming service available via two (2) service plans: (i) a standard plan with a usual retail price of $14.48 (inclusive of GST) per month, which allows streaming on two (2) devices at once for each Max account (“Max Standard”); or (ii) an ultimate plan with a usual retail price of $18.98 (inclusive of GST) per month, which allows streaming on four (4) devices at once for each Max account (“Max Ultimate”).

2.2 The retail prices of the Max service and the number of concurrent streams available for use shall be subject to change at the sole discretion of WarnerMedia Direct Asia Pacific, LLC.

2.3 The Max service is available on website, mobile apps, Android TV app and selected Smart TV brands and gaming consoles.

2.4 Prevailing data charges apply for streaming Max content through StarHub Post-Paid Mobile Services and you agree that it is subject to reasonable use and our fair usage policy.

 

3. Eligibility Criteria and Max Bundled Access

3.1 Max is available as a bundled access for StarHub customers on selected plans during the time period in which StarHub makes the Promotion available, as specified below.

For StarHub TV and HomeHub customers

3.1.1 From 19 November 2024 until such time we may determine, all active StarHub TV or HomeHub residential customers holding either a) HBO Pak, or b) Box Office Pack, or c) Supreme Box Office Pack, or d) Movies Pass, are eligible to access Max based on the active subscription of the above eligible plans. The Max bundled access will commence from the activation date of the above eligible plan;

For StarHub TV+ and HomeHub+ customers

3.1.2 From 19 November 2024 until such time we may determine, all active StarHub TV+ or HomeHub+ residential customers holding either a) HBO Pak, or b) HomeHub+ UltraSpeed 5Gbps (Max), or c) HomeHub+ UltraSpeed 10Gbps (Max), are eligible to access Max based on the active subscription of the above eligible plans. The Max bundled access will commence from the activation date of the above eligible plan;

(collectively, the "Eligible StarHub Services" and each an "Eligible StarHub Service").

 

4. Activation of Max

4.1 As part of the activation process, you will be sent a link to your registered mobile number or email with StarHub for the purposes of redeeming and activating your Max account (“Link”), and you are required to create a Max account with a valid email address and password.

4.2 To take advantage of the bundled access, you are required to activate your Max account within 30 days from receiving the Link and must not use the same email address you used to purchase an existing Max subscription.

4.3 Activation Mechanism

4.3.1 After your StarHub service order is completed, you will be sent a Link to activate the Max account via the StarHub App.

4.3.2 When “Activate Now” is selected on the StarHub App, you will be re-directed to the Max website to create an account with Max.

4.3.3 Before streaming, the Max activation process must first be completed, followed by downloading the Max app from the respective stores on supported platforms or by visiting the Max website.

5. Add-On Promotion

5.1 Outside of the bundled access, StarHub Broadband or Post-Paid Mobile customers who are not on the Eligible StarHub Services can choose to subscribe to Max Standard as an add-on Service by paying the prevailing monthly recurring charges (“Max Add-On”). 

5.2 From 19 November 2024 until such time we may determine, the Max Add-On Promotion provides you with a price of $9.00/month (inclusive of GST) instead of the usual retail price at $14.48/month (inclusive of GST). The Minimum Period of Service is 24 months. 

5.3 Monthly subscription fee of the Max Add-On is non-prorated and the bill will not follow your StarHub Broadband or Post-Paid Mobile billing cycle. You will be billed based on the activation of your Max Add-On. For example, if your Post-Paid Mobile bill cycle is on 12th of every calendar month and you activated your Max Add-On on 19th November, you will be charged for the monthly subscription from 19th November to 18th December.

5.4 If the Max Add-On is terminated during the Minimum Period of Service, an early termination charge (“ETC”) will be payable based on the remaining contractual period multiplied by the usual monthly recurring charges of the Max Add-On terminated. 

5.5 You are entitled to a maximum of one Max Add-On for each StarHub Broadband or Post-Paid Mobile service that you hold.

5.6 The Max Add-On is only available through the StarHub App where eligible customers must opt in for Max through the StarHub App.

5.7 To activate your Max Add-On, you must complete the subscription process via the StarHub App, and when directed to the Max website to create an account with Max, you must complete the Max account activation process.

5.8 This Promotion is not available to customers whose accounts are blacklisted or with outstanding balances.

 

6. Upgrade or Downgrade

6.1 Unless you enjoy Max as a bundled access or subscribe to Max as an Add-On Service, you may request to upgrade or downgrade your Max subscription plan via the StarHub App. 

6.2 Subject to Clause 6.1, you may upgrade your Max Standard plan to a Max Ultimate plan via the StarHub App. Your new plan will take effect from your next billing cycle. You will also be billed at the new rate from your next billing cycle.

6.3 Monthly subscription fee of the upgrade to Max Ultimate is equivalent to the usual retail price difference between the Max Standard and Max Ultimate Plans. You acknowledge that the usual retail price for Max Ultimate is solely determined, managed and controlled by Max, not StarHub.

6.4 Subject to Clause 6.1, you may downgrade your Max Ultimate plan to a Max Standard plan via the StarHub App. Your new plan will take effect from the next billing cycle. You’ll be able to enjoy the additional features of Max Ultimate till then. You will also be billed at the new rate from your next billing cycle.

 

7. Switching from direct Max subscription over to StarHub

7.1 If you have subscribed to a Max Standard plan directly through Max and have used the same email address to activate your Max Standard bundled access or Max Add-On from StarHub, your existing Max Standard plan subscription directly through Max will be cancelled upon your confirmation to be billed through StarHub.

7.2 If you have subscribed to a Max Ultimate plan directly through Max and have used the same email address to activate your Max Standard bundled access or Max Add-On from StarHub, your existing Max Ultimate plan subscription directly through Max will continue and you will concurrently be billed for Max Standard by StarHub (“Double Billing”).

7.3 In the event that Double Billing occurs to you, please reach out to Max to manage your direct subscription through Max.

 

8. Viewing of Max on StarHub TV+ Set-Top Box

8.1 You need to (a) download and install the Max app via the Google Play Store on your StarHub TV+ set-top box and (b) activate Max via the StarHub App before you can log in to your Max account via the Max app on the StarHub TV+ set-top box.  For clarity, Max cannot be activated from the StarHub TV+ set-top box directly.

8.2 From time to time, you may be required to update the Max app via the Google Play Store which you will be required to login with your Google account.

 

9. Modification, Suspension, Termination

9.1 If you enjoy Max as a bundled access or subscribe to Max as an Add-On Service, unsubscribing from Max through the StarHub App is not available to you during the bundled access period or Minimum Period of Service respectively.

9.2 Continuous subscription to the Eligible StarHub Services is a prerequisite for Max bundled access. You must subscribe and maintain the Eligible StarHub Services to continue with Max bundled access. If your Eligible StarHub Service(s) have been suspended (either voluntarily or due to dunning), the associated Max entitlement will be terminated at the same time. Your Max entitlement will resume when you restart your subscription of the Eligible StarHub Service and you will need to activate your Max account again.

9.3 Early termination of your Eligible StarHub Service (for any reason(s)) or a transfer in ownership of the Eligible StarHub Service will result in an automatic and immediate termination of your Max entitlement without further notice to you.

9.4 An ETC applies if your Max Add-On is terminated as a result of termination of your StarHub Post-paid service within the Minimum Period of Service.

10. Customer Support

10.1 Please contact StarHub only for queries related to (i) availing the Promotion and/or the eligibility criteria for the Promotion; (ii) activation or deactivation of the Max service as part of the Promotion; (iii) general billing enquiries related to the Promotion or your account.

10.2 For any queries, disputes or concerns on the Max service or the Max app, you agree to contact Max directly to address such queries, disputes or concerns.

11. Additional Terms for the Promotions

11.1 This Promotion is only available until such date as we may determine and may be rescinded at anytime.

11.2 This Promotion cannot be used to offset existing subscription charges or outstanding balances due to StarHub.

11.3 Any standalone subscription to the Max service cannot be substituted for the Promotion.

11.4 This Promotion is non-exchangeable for cash or kind, is non-refundable and non-transferable.

11.5 Unless we specify otherwise, this Promotion is not available with other discounts, promotions, special packages or external offers.

11.6 StarHub reserves the right to determine your entitlement to this Promotion, and StarHub/WarnerMedia Direct Asia Pacific, LLC may reject any application for Max, at its sole discretion.

11.7 StarHub further reserves the right to revise any of these Promotion Terms & Conditions and/or the Service Specific Terms & Conditions for StarHub TV+ Services, StarHub Post-Paid Mobile Services, StarHub Broadband Services, HomeHub, price plans, fair usage policies, at its sole discretion, at any time, without prior notice and without liability. Your use of the StarHub TV+ Services, StarHub Post-Paid Mobile Services, StarHub Broadband Services, HomeHub (as applicable) will constitute acceptance of these Promotion Terms & Conditions and the amendments thereof.

11.8 These Promotion Terms & Conditions shall be governed by the laws of Singapore and parties agree to be bound by and submit to the exclusive jurisdiction of the courts of Singapore.
